INTRODUCTION AND ACCEPTANCE
1.1. Company Information. These Terms and Conditions (“Terms”) govern your use of the website adciti.co.zw (“the Site”), operated by Adciti (“Company,” “we,” “us,” or “our”), a classifieds platform based in Zimbabwe. Our contact email is cchisango@cchub.co.zw.
1.2. Acceptance. By accessing, browsing, or posting an advertisement on Adciti, you (“User,” “you”) acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any other policies referenced herein.
1.3. Legal Capacity. By using this Site, you represent that you are at least 18 years of age or have legal parental/guardian consent. You further confirm that you are capable of entering into a legally binding agreement under Zimbabwean law.
ROLE OF ADCITI (CLASSIFIEDS MARKETPLACE)
2.1. Platform Only. Adciti operates strictly as an online classifieds marketplace and information provider. We are not a party to any transaction between buyers and sellers.
2.2. No Agency. We do not act as an agent, broker, auctioneer, or representative for any user. We do not hold title to goods, take possession of goods, or facilitate the transfer of ownership.
2.3. No Funds Holding. Under no circumstances does Adciti hold funds on behalf of users. All financial transactions, including payments for goods or services listed on the Site, occur directly between the buyer and the seller. We do not operate an escrow service.
2.4. Limitation of Liability for Transactions. Because we are not involved in the actual transaction between buyers and sellers, we have no control over the quality, safety, or legality of items advertised, the truth or accuracy of listings, or the ability of sellers to sell items or buyers to pay for them. We cannot guarantee that a buyer or seller will complete a transaction.
PAYMENT FOR SERVICES (ECOCASH & E-RECEIPTS)
3.1. Paid Services. Adciti may charge fees for premium listings, “bumped” ads, or featured placements (“Paid Services”).
3.2. Offline EcoCash Payments. All payments for Adciti’s Paid Services are processed via EcoCash.
Process: Payments are conducted offline or manually. This means you initiate the payment via your EcoCash account to our registered merchant number, and you must follow the instructions provided on the Site.
Verification: You are responsible for ensuring the accuracy of the merchant details and the exact amount before sending money.
3.3. E-Receipt. Upon successful confirmation of payment (credit reflected in our account), we will generate and send a unique Electronic Receipt (E-Receipt) to your registered email address or phone number. This E-Receipt serves as the sole proof of your purchase of advertising services from Adciti .
3.4. Refund Policy. Due to the digital nature of the services (e.g., ad visibility), all payments for listing fees are non-refundable once the ad is live, except where required by the Consumer Protection Act [Chapter 14:14] regarding service quality failures. Refunds, if approved, will be processed back to the original EcoCash number used for payment.
RIGHT TO DECLINE, SUSPEND, OR TERMINATE SERVICES
4.1. Editorial Discretion. Adciti reserves the absolute right, in its sole discretion, to decline, edit, suspend, or remove any advertisement, listing, or user account for any reason, including but not limited to:
Violation of these Terms.
Misleading, illegal, or prohibited content.
Excessive complaints from other users.
Technical errors in the listing.
4.2. No Refund for Removal. If an ad is removed due to a violation of these Terms, no refund for paid services will be issued.
INFORMATION WE COLLECT (PRIVACY & DATA PROTECTION)
5.1. Data Collection. In compliance with the Cyber and Data Protection Act [Chapter 12:07] , we inform you that we collect the following personal information:
Email Address: For account verification and communication.
Phone Numbers: To facilitate contact between buyers and sellers.
Location Data: To provide relevant local search results.
5.2. Lawful Basis. We process this data based on your consent (when you post an ad) and our legitimate interest in operating a functional marketplace.
5.3. Data Security. We implement reasonable technical and organizational measures to protect your data from unauthorized access or loss. However, no internet transmission is 100% secure.
5.4. User Responsibility. You are responsible for the content you post. Do not post sensitive personal data (e.g., ID numbers, passwords) in public listing fields.
USER CONDUCT AND PROHIBITIONS
You agree NOT to use Adciti to:
Post any content that is illegal, fraudulent, defamatory, obscene, or violates the rights of others.
Advertise prohibited items including, but not limited to: illicit drugs, firearms (without proper licenses as defined by Zimbabwean law), stolen goods, human body parts, or endangered species.
“Spam” or post duplicate ads in an attempt to dominate search results.
Harvest user data for unsolicited marketing.
DISCLAIMER OF WARRANTIES
7.1. “AS IS” Basis. The Site and its services are provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by Zimbabwean law, Adciti disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
7.2. No Guarantee of Sale. Adciti does not guarantee that you will sell your item or find a buyer for your service.
LIMITATION OF LIABILITY
8.1. Exclusion of Consequential Damages. To the maximum extent permitted by the Consumer Protection Act [Chapter 14:14] , Adciti, its owners, or employees shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site, including loss of profits, data, or goodwill.
8.2. Cap on Liability. In the event we are found liable for a direct breach, our total liability to you shall not exceed the total fees (if any) you paid to Adciti in the six (6) months preceding the claim, or USD $10.00, whichever is lower.
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Adciti from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of the rights of any third party, including other buyers/sellers; or (d) any transaction you enter into via the Site.
DISPUTE RESOLUTION AND GOVERNING LAW
10.1. Governing Law. These Terms shall be governed by and construed in accordance with the laws of the Republic of Zimbabwe.
10.2. Dispute Resolution. If a dispute arises between a buyer and seller, you agree to attempt resolution directly with that user first. If a dispute arises regarding Adciti’s services (e.g., billing), please contact us at cchisango@cchub.co.zw.
Consumer Protection: You retain the right to file a complaint with the Consumer Protection Commission or seek redress in the Small Claims Court or Magistrates Court as permitted by law.
10.3. Jurisdiction. You irrevocably submit to the exclusive jurisdiction of the courts of Zimbabwe, for any matters where Adciti is a party.
AMENDMENTS
Adciti reserves the right to modify these Terms at any time. Changes become effective immediately upon posting to the Site. Your continued use of the Site following the posting of revised Terms constitutes acceptance of those changes.
